DOVER - A Rochester man will spend at least 4-8 years in a New Hampshire State Prison after he was sentenced on Thursday for the brutal rape of a woman who was unconscious during an August 2021 sexual assault in Rochester.
Scott Barrett, 48, of Charles Street, Rochester, was found guilty on April 10 of three charges of aggravated felonious sexual assault (physically helpless victim) following a jury trial in Strafford Superior Court.
According to a State Sentencing Memorandum submitted by Strafford County Assistant Attorney Hannah E. Ward, a female companion of Barrett broke off a sexual encounter the night of Aug. 31, 2021, when she began to feel unwell, took a Tylenol and went to sleep.
Over the next few days she began to feel pain in her lower abdomen and confronted Barrett, who said he'd stopped shortly after she became unconscious, according to the memorandum.
But the victim's pain and concerns remained, and on Sept. 4, 2021, she decided to review footage from a camera located in her bedroom.
According to the sentencing memorandum, "While reviewing the recording (the victim) observed the defendant engaging in sexual intercourse and sexual conduct over a period of one hour, while (the victim) appears to be unconscious."
Barrett, who was charged by indictment first in August 2022, was also sentenced to two eight- to 16-year prison terms for two more charges of aggravated felonious sexual assault (physically helpless victim), all suspended for 5-10 years following his release.
Barrett, who was indicted on various charges connected with the case in August 2022, October 2022 and again in August 2023. faced up to 80 years in prison if convicted on all charges, which included witness tampering.
As part of his sentence Barrett will also have to take part in sex offender assessments and prescribed treatments.
Barrett can shave 1.5 years of his stand-committed sentence if he fully completes a sex offender program.
