Police still on lookout for accomplice in glass pipes theft

ROCHESTER - Rochester Police are still looking for the man they say conspired with a Rochester transient to steal glass pipes from a Rochester discount beverage outlet in January.

In the meantime, Joshua Michael Day, 30, the man police say distracted the clerk at the Highland Street Borderline Beverage, was arrested on Saturday and charged with criminal liability for conduct of another, a Class B misdemeanor that carries no jail time.

Rochester Police Capt. Todd Pinkham said the charge alleges that the two conspired in the theft.

"Day distracted the clerk at Borderline Beverages while another male stole the glass pipes," Pinkham said. "We believe they conspired. The two men walked into the store together on Jan 21. One man distracts the clerk and blocks his view of the other male while that male then steals some glass pipes from a display case."

Pinkham said police used surveillance video in their investigation.

So far they have not been able to identify the alleged accomplice who is said to have actually stolen the merchandise.
