Plea deal set for one, options weighed on the other in Walmart theft scheme

DOVER, N.H. - A Milton man is expected to plead guilty today to three felony counts of theft in an organized retail crime enterprise but will serve no additional jail time, the Strafford County Attorney said Wednesday.

Kristopher Henner, 23, with a last known address of Pineland Park, was charged along with Nicole Perry, 20, of Felker Drive, Milton, in three incidents in which they allegedly sought to defraud the Rochester Walmart on March 14, 23 and 26 of last year.

The way the scheme is said to have worked is Henner would steal the items, which would later be returned for gift cards by Perry, County Attorney Tom Velardi said.

Velardi said when the indictment was brought forward in December Henner was already in jail for another offense. He was released a couple of months ago.

Velardi said the County Attorney's Office is now weighing how to proceed against Perry, who was indicted in connection with the case in November.

He said the three theft incidents from March 2015 garnered the pair about $150.
