CONCORD - Following engagement with the New Hampshire Attorney General's Office, Dartmouth Health has officially revised its kidney transplant policy, according to AG John M. Formella.

Moving forward, Dartmouth Health will no longer require kidney transplant candidates to be vaccinated against COVID-19.

"After reviewing the matter and engaging with Dartmouth Health, we are pleased that they have taken the steps necessary to align their policies with the rights of patients and the requirements of State law," Formella said in a statement sent on Wednesday. "This is a positive outcome for New Hampshire residents seeking transplant care. The Attorney General's Office will continue to prioritize consumer protection and fair practices in healthcare, ensuring that New Hampshire residents receive safe, accessible, and non-discriminatory medical treatment."

This change follows the Attorney General's direction to his Consumer Protection and Antitrust Bureau to review the issue, following concerns raised by a transplant candidate about the institution's COVID-19 vaccination requirement for kidney transplant candidates.

As a result of discussions with the Bureau, Dartmouth Health has decided to strongly recommend, but not require, COVID-19 vaccination as a condition for kidney transplant eligibility. The transplant team will encourage candidates to receive the COVID-19 vaccine in order to protect the health of transplant recipients, who are at higher risk due to immunosuppressive treatments.
