ROCHESTER - One of the men arrested in the attempted burglary of Jimmy’s Smoke Shop earlier this fall pleaded guilty and was sentenced to a year in jail on Tuesday in Rochester District Court.
According to a plea deal reached with prosecutors, Douglas Moore, 25, a transient, was given credit for 51 days of pretrial incarceration with the remainder of the sentence suspended. He must complete drug abuse and mental health counseling to remain out of jail, according to his sentencing conditions. The court also reduced his charge from attempted burglary to criminal mischief.
Moore was also ordered to stay away from Jimmy’s Smoke Shop as part of his sentencing conditions. He will remain on probation for 12 months.
