Former New Durham man indicted in contractor theft case

CONCORD - The state's Attorney Generals Office on Friday announced the indictment of a former New Durham man in a felony theft by unauthorized taking case.

The indictment by a multicounty Grand Jury indictment accuses Kevin Clague d/b/a Clague's Contracting and Design, LLC, 38, of Churubusco, Ind., formerly of New Durham, with one Class A felony count of theft by unauthorized taking related to a contract to build a deck in Alton Bay.

The indictment alleges that between June 27, 2018, and Nov. 30, 2018, pursuant to a course of conduct, Clague obtained or exercised unauthorized control over the money of L.M. with a purpose to deprive him thereof, and the value of the money exceeded $1,500.

Class A felonies are punishable by up to 7½-15 years at the New Hampshire State Prison and/or a maximum fine of $4,000 for each charge. Clague is scheduled for an arraignment on Oct 28 in Belknap County Superior Court.

An indictment is merely and accusation, and Clague is presumed innocent unless and until proven guilty.

Assistant Attorney General Gregory M. Albert of the Consumer Protection and Antitrust Bureau is prosecuting this case.
