Dover man indicted in violent sex assault on Somersworth woman

DOVER - The Dover man twice released back into the community on no bail over the objections of Strafford Community Corrections has been indicted on second degree assault and attempted aggravated felonious sex assault charges in connection with his alleged attack on a Somersworth woman inside her mobile home in September.

According to the indictment, Donald Ray Levier, 35, of 3 Bear's Way, knowingly engaged in the strangulation of (the female victim) by placing his hand and/or hands on or around (her) neck, causing impeded breathing and/or blood circulation.

The sex assault charge alleges Levier attempted engage in coitus by "forcing (the victim) onto her bed, grabbing (the victim's) vaginal area after having taken off his clothes, and saying words to the effect of 'let me taste it.'"

The Sept. 5 sex assault charge is a Special Felony punishable by 10-20 years, while the second-degree/strangulation charge carries a three and a half- to seven-year sentence.

Levier was also charged with two misdemeanor counts of sex assault.

Somersworth Police say they responded to a mobile home park after someone reported hearing a female yelling for help.

According to a Somersworth Police affidavit, responding officers found Levier gained access to a mobile home belonging to a female and attempted to sexually assault the victim by throwing her on a bed and trying to remove her pants and underwear.

The Somersworth incident report also alleges he slapped and strangled her and also held her down.

Police found Levier with no clothes on in the woman's bathroom where he was arrested.

Two assessments done by Strafford County Community Corrections found Levier unsuitable for pretrial release, but Judge Mark S. Howard ordered him released nonetheless.

Soon after he was released the second time he attempted to sexually assault an elderly Dover woman in her New York Street apartment.

The woman told The Rochester Voice she is now afraid to be outside and will likely leave the area.
